1. Загальні положення

Ці Умови регулюють участь у програмі лояльності «Перша Столиця» та користування однойменним мобільним застосунком. Організатор програми та володілець застосунку — Фізична особа — підприємець Гриненко Станіслав Анатолійович («Оператор»), м. Харків, Україна. Реєструючись у застосунку, ви приєднуєтеся до програми та приймаєте ці Умови. Якщо ви не згодні з ними — не використовуйте застосунок.

Щодо самого мобільного застосунку, завантаженого з App Store, додатково діє стандартна ліцензійна угода Apple (Licensed Application End User License Agreement); у частині програми лояльності пріоритет мають ці Умови.

2. Застосунок і сервіс

Застосунок надає: електронну картку лояльності зі штрихкодом, баланс та історію балів, каталог і акції фірмових магазинів, мапу магазинів, реферальну програму та сповіщення. Сервіс надається безкоштовно; покупки здійснюються та оплачуються виключно на касах магазинів.

3. Обліковий запис

• Учасником може стати фізична особа віком від 16 років з українським номером телефону (+380).
• Один номер телефону — один обліковий запис і одна картка лояльності. Вхід здійснюється за одноразовим SMS-кодом; нікому не повідомляйте його.
• Ви відповідаєте за достовірність зазначених даних та за дії, вчинені через ваш обліковий запис.
• Картка діє у 49 фірмових магазинах мережі «Перша Столиця».

4. Бали

• Бали нараховуються за покупки у фірмових магазинах при пред'явленні картки з застосунку. Поточну ставку нарахування видно у застосунку.
• 1 бал = 1 копійка знижки (100 балів = 1 гривня) при оплаті наступних покупок.
• Балами можна оплатити до 50% суми покупки, якщо на касі не визначено інше.
• Бали не є грошима та електронними грошима, не обмінюються на готівку, не передаються іншим особам і не успадковуються.
• Строк дії балів: бали згорають, якщо за обліковим записом немає жодної покупки протягом 12 місяців поспіль.
• У разі повернення товару відповідні нараховані бали можуть бути скориговані.
• Помилково нараховані бали Оператор має право скоригувати з повідомленням учасника.

5. Реферальна програма

• Кожен учасник має особистий код запрошення (Профіль → Запросити друга).
• Коли запрошена людина реєструється з кодом і робить першу покупку — і вона, і той, хто запросив, отримують бонусні бали (розмір указано в застосунку).
• Код можна застосувати один раз, лише до першої покупки, і не до власного акаунта.

6. Акції та інформація в застосунку

Асортимент, ціни, акції та знижки визначаються Оператором і можуть змінюватися без попередження. Фотографії товарів мають інформаційний характер; фактичні характеристики товару вказуються в магазині. Акційні пропозиції діють у строки та на умовах, зазначених для кожної акції.

7. Заборонене використання

Забороняється: створення фейкових облікових записів, зловживання реферальною програмою (масові чи фіктивні реєстрації), спроби втручання в роботу застосунку чи серверів, використання чужої картки без дозволу її власника. Порушення може призвести до скасування нарахованих бонусів, блокування облікового запису та виключення з програми.

8. Інтелектуальна власність

Застосунок, торговельні назви, логотипи, дизайн і контент належать Оператору або використовуються ним на законних підставах. Використання поза межами звичайного користування застосунком без письмової згоди Оператора заборонено.

9. Відповідальність

Застосунок надається «як є». Оператор докладає розумних зусиль для безперебійної роботи, але не гарантує відсутності технічних перерв (зокрема на обслуговування). Оператор не відповідає за неможливість скористатися балами через обставини непереборної сили або технічні збої третіх осіб (оператори зв'язку, платформи сповіщень). Ніщо в цих Умовах не обмежує права, надані вам законодавством про захист прав споживачів.

10. Припинення участі

• Ви можете будь-коли припинити участь, видаливши акаунт у застосунку (Профіль → Налаштування → Видалити акаунт); невикористані бали при цьому анулюються.
• Оператор може припинити або призупинити програму лояльності, попередивши учасників у застосунку щонайменше за 30 днів; нараховані бали можна буде використати протягом цього строку.

11. Зміни цих Умов

Оператор може змінювати правила нарахування, асортимент акцій та ці Умови; чинна редакція завжди опублікована на цій сторінці із зазначенням дати. Суттєві зміни анонсуються у застосунку до набрання чинності. Продовження користування застосунком після змін означає згоду з ними.

12. Право, що застосовується

До цих Умов застосовується право України. Спори вирішуються шляхом переговорів, а в разі недосягнення згоди — у порядку, встановленому законодавством України.

Loyalty Program Terms

Effective date: 22 July 2026. The Ukrainian version above is the governing text; this English translation is provided for convenience.

1. General

These Terms govern participation in the «Persha Stolytsia» loyalty program and the use of the mobile app of the same name. The program operator and app owner is Individual entrepreneur (FOP) Hrynenko Stanislav Anatoliiovych (the "Operator"), Kharkiv, Ukraine. By registering in the app you join the program and accept these Terms. If you do not agree with them, do not use the app.

The mobile app downloaded from the App Store is additionally covered by Apple's standard Licensed Application End User License Agreement; for matters of the loyalty program itself, these Terms prevail.

2. The App and the Service

The app provides: a digital loyalty card with a barcode, your points balance and history, the catalog and promotions of the brand stores, a store map, a referral program, and notifications. The service is free of charge; purchases are made and paid for exclusively at store checkouts.

3. Account

• Participants must be at least 16 years old and have a Ukrainian phone number (+380).
• One phone number — one account and one loyalty card. Sign-in uses a one-time SMS code; never share it with anyone.
• You are responsible for the accuracy of the data you provide and for actions taken through your account.
• The card is valid in 49 brand stores of the «Persha Stolytsia» chain.

4. Points

• Points are earned on purchases in brand stores when you present the card from the app. The current earning rate is shown in the app.
• 1 point = 1 kopiyka of discount (100 points = 1 hryvnia) when paying for subsequent purchases.
• Points may cover up to 50% of a purchase amount unless stated otherwise at the till.
• Points are not money or electronic money, cannot be exchanged for cash, transferred to other persons, or inherited.
• Expiry: points lapse if the account has no purchases for 12 consecutive months.
• If goods are returned, the corresponding earned points may be adjusted.
• The Operator may correct points credited in error, with notice to the participant.

5. Referral Program

• Every participant has a personal invitation code (Profile → Invite a friend).
• When an invited person registers with the code and makes their first purchase, both they and the inviter receive bonus points (the amount is shown in the app).
• A code can be applied once, only before the first purchase, and not to one's own account.

6. Promotions and In-App Information

The assortment, prices, promotions and discounts are set by the Operator and may change without notice. Product photos are for information purposes; the actual characteristics of goods are indicated in the store. Promotional offers are valid for the periods and under the conditions stated for each promotion.

7. Prohibited Use

The following are prohibited: creating fake accounts, abusing the referral program (mass or fictitious registrations), attempting to interfere with the operation of the app or servers, and using another person's card without the owner's permission. Violations may result in cancellation of credited bonuses, account suspension, and exclusion from the program.

8. Intellectual Property

The app, trade names, logos, design and content belong to the Operator or are used by it lawfully. Any use beyond ordinary use of the app without the Operator's written consent is prohibited.

9. Liability

The app is provided "as is". The Operator makes reasonable efforts to keep the service running but does not guarantee the absence of technical interruptions (including maintenance). The Operator is not liable for the inability to use points due to force majeure or technical failures of third parties (mobile carriers, notification platforms). Nothing in these Terms limits the rights granted to you by consumer protection law.

10. Termination

• You may stop participating at any time by deleting your account in the app (Profile → Settings → Delete account); unused points are then forfeited.
• The Operator may terminate or suspend the loyalty program with at least 30 days' notice in the app; credited points can be used during that period.

11. Changes to These Terms

The Operator may change the earning rules, the range of promotions and these Terms; the current version is always published on this page with its date. Material changes are announced in the app before they take effect. Continued use of the app after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the law of Ukraine. Disputes are resolved through negotiations and, failing agreement, in the manner established by Ukrainian law.
